Payment of Wages Act, 1936

The object of this act is to regulate the payment of wages of certain classes of employed persons.

Minimum Wages Act, 1948

Fixing minimum rates of wages in certain employees.

Payment of Bonus Act, 1965

This act is applicable to every factory wherein 10 or more people are employed with the aid of power or any establishment with 20 or more people working on any day during an accounting year.*

Factories Act, 1948

Any premises where 10 or more persons with the aid of power or 20 or more workers are without aid of power working on any day preceding 12 months, wherein manufacturing process is being carried.

Building and other construction workers Welfare Cess Act, 1996

An Act to provide for the levy and collection of a cess on the cost of construction incurred by employers with a view to augmenting the resources of the Building and Other Construction Workers’ Welfare Boards constituted under the Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996.

An Act to provide for the regulation of private security agencies and for matters connected therewith or incidental thereto.

Maternity Benefits Act, 1961

The object of this act is to protect the dignity of motherhood and respect the new person’s birth by providing full maintenance of the woman and her child when she is not working.

Equal Remuneration Act, 1976

To provide for the payment of equal remuneration to men and women workers and for the prevention of discrimination, on the ground of sex, against women, in the matter of employment and for connected or incidental matters.

Employees State Insurance Act, 1948

This act is extended in area-wise to factories using power and employing 10 or more persons and to non-power using manufacturing units and establishments including educational institutions employing 10 or more persons.

Employees Provident Fund and Misc. Provision Act, 1952

This is applicable to all establishment which are factory engaged, having 20 or more employees. Any establishment employing less than 20 may voluntarily opt to be covered under this Act.

Employee’s Compensation Act, 1923

To provide compensation to the employees by their employers for injury which may be suffered by them as a result of an accident during the course of employment, and in case of a fatal injury, his dependants should be compensated. The Act also provides security to the employees who become partially incapacitated resulting in a loss in their earning capacity.

Payment of Gratuity Act, 1972

This act is applicable to very factory, mine, oil field, plantation, port, railways, company, shop, establishments or educational establishment’s employing 10 or more employees

Industrial Dispute Act, 1947

Object is to provide investigation and settlement of any industrial disputes and for certain other purposes.

The Sexual Harassment Of Women At Workplace Act, 2013

This act is to protect women from any kind of sexual harassment. The wide definition includes physical contact, demand or request for sexual favours, sexual remarks, pornography and any other physical, verbal or non-verbal conduct of sexual nature.

Trade Unions Act, 1926

Provide registration of trade unions and in certain respects to define the law relating to registered trade unions.

The Superannuation scheme

Superannuation refers to the retirement benefit offered to the working class. In India, there are two types of superannuation benefits:

Defined Benefit Plans: These schemes have a defined benefit which is fixed and known to the employees based on their service, rank and final salary. These are more popular among the employees, since regardless of their contribution to the plan they are entitled to the pension

Defined Contribution Plans: These schemes are better to manage as the final benefit is directly correlated with the contributions by employers and employees. The scheme only defines the contribution of both and leaves the outcome to the market forces. Most of the modern pension schemes are defined contribution plans.

Appeal under Employee Provident Fund Tribunal

This Act may be called the Employees’ Provident Funds and Miscellaneous Provisions Act, 1952. It applies to every establishment which is factory engaged in any industry specified in Schedule I and in which 20 or more persons are employed, and to any other establishment employing 20 or more persons or class of such establishments which the Central Government may, by notification in the Official Gazette, specify in this behalf: Provided that the Central Government may, after giving not less than two months’ notice of its intention so to do, by notification in the Official Gazette, apply the provisions of this Act to any establishment employing such number of persons less than 20 as may be specified in the notification. Notwithstanding anything, where it appears to the Central Provident Fund Commissioner, whether on an application made to him in this behalf or otherwise, that the employer and the majority of employees in relation to any establishment have agreed that the provisions of this Act should be made applicable to the establishment, he may, by notification in the Official Gazette, apply the provisions of this Act to that establishment on and from the date of such agreement or from any subsequent date specified in such agreement. An establishment to which this Act applies shall continue to be governed by this Act notwithstanding that the number of persons employed therein at any time falls below twenty.
